Terms of Service

By accessing or using the Bazaario platform at bazaario.app (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

Bazaario is a community marketplace platform that connects consumers with local service vendors and product sellers, and provides event management tools for organizers. The platform currently serves the Washington DC, Maryland, and Virginia (DMV) metropolitan area.

The Service provides tools for event discovery and ticketing, vendor applications to events, vendor profiles and storefronts, messaging between users, and payment processing. Bazaario acts as a platform facilitator and is not a party to transactions between users.

To use most features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and account credentials.
• Promptly update your information if it changes.
• Accept responsibility for all activity that occurs under your account.
• Maintain only one account per person. Creating multiple accounts to circumvent restrictions or manipulate the platform is prohibited.

The Service supports three user roles, each with specific responsibilities:

Consumers

• Use the platform to discover events, purchase tickets, browse vendors, and communicate with vendors.
• Provide accurate information when making purchases or booking services.
• Engage respectfully with vendors and organizers.

Vendors

• Provide accurate business information, including category, location, and service descriptions.
• Fulfill commitments made to consumers and event organizers.
• Comply with all applicable local, state, and federal laws, including obtaining necessary licenses and permits.
• Respond to customer inquiries and booking requests in a timely manner.

Organizers

• Provide accurate event information, including dates, venue, categories, and ticket details.
• Manage vendor applications fairly and in a timely manner.
• Ensure events comply with all applicable laws, regulations, and venue requirements.
• Honor ticket purchases and vendor booth agreements.

Payments on Bazaario are processed through Stripe Connect. Vendors and organizers must connect a Stripe account to receive payments.

• Platform fees: Bazaario currently charges 0% platform fees on all transactions. Vendors and organizers keep 100% of their revenue. We reserve the right to introduce platform fees in the future with at least 30 days' advance notice to affected users.
• Stripe fees: Standard Stripe processing fees apply to all paid transactions. These fees are set by Stripe and are separate from any Bazaario platform fees.
• Pricing: Vendors set their own prices for services and products. Organizers set their own ticket prices and booth fees. Bazaario does not control or guarantee pricing.
• Free tickets: Tickets priced at $0 are processed directly on the platform without involving Stripe payment processing.

Refund policies are determined by individual vendors and event organizers. Bazaario facilitates refund processing through Stripe but is not responsible for refund decisions.

• Consumers should contact the vendor or organizer directly regarding refund requests.
• If a vendor or organizer is unresponsive, you may contact Bazaario at hello@bazaario.app for assistance.
• Bazaario reserves the right to facilitate refunds in cases of fraud, misrepresentation, or cancelled events.

You retain ownership of all content you upload to the Service, including text, images, logos, and other materials ("User Content").

By uploading User Content, you grant Bazaario a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and promoting the Service. This license ends when you delete your content or account, except where your content has been shared with others and they have not deleted it.

You represent that you have the right to upload all content you submit and that it does not infringe on any third party's intellectual property or other rights.

You agree not to:

• Use the Service for any fraudulent, deceptive, or illegal purpose.
• Harass, threaten, or discriminate against any user.
• Circumvent the platform's payment system (e.g., arranging off-platform payments to avoid fees or record-keeping).
• Scrape, crawl, or use automated means to access the Service without our written permission.
• Impersonate another person, business, or entity.
• Upload malicious content, including viruses, malware, or spam.
• Interfere with or disrupt the Service or its infrastructure.
• Create multiple accounts to circumvent suspensions or restrictions.
• Use the Service to promote illegal goods or services.

Disputes between users (consumers, vendors, and organizers) should be resolved directly between the parties involved. Bazaario may, at its discretion, mediate disputes but is not obligated to do so.

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in Virginia, and you consent to the jurisdiction of such courts.

Bazaario is a platform that facilitates connections between consumers, vendors, and organizers. We are not a party to transactions between users and do not guarantee the quality, safety, legality, or availability of any services, products, or events listed on the platform.

To the maximum extent permitted by law, Bazaario and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to Bazaario (not to vendors or organizers) in the twelve months preceding the claim.

You agree to indemnify, defend, and hold harmless Bazaario, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any rights of another user or third party.
• Any content you upload or submit to the Service.

You may terminate your account at any time by contacting us at hello@bazaario.app.

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or for any other reason at our sole discretion.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including indemnification, limitation of liability, and dispute resolution) will remain in effect.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and notify affected users via email or a prominent notice on the Service at least 30 days before the changes take effect.

Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service and contact us to close your account.
